If you are a landlord in Arizona, knowing the Arizona Residential Landlord and Tenant Act (ARLTA) is a must. It lays out expectations for what timing is required for repairs. If you miss those timelines, you could face fines or even tenant lawsuits.
The Legal Repair Timeline
Under ARLTA, landlords are required to maintain rental properties in “fit and habitable” condition. That includes plumbing, AC, hot water, and anything that affects health and safety. Bottom line: the property that you have rented to a tenant for them to use as a residence needs to fulfill why they’d rented it.
When a tenant reports a problem, you have:
10 days to make the repair for general issues
5 days if the issue affects health or safety (broken AC, plumbing leak, faulty electrical, etc)
These timelines technically begin when the tenant provides written notice of the issue.
The Better Repair Timeline
If you have 10 days to repair a problem, and the tenant has notified you verbally, does that mean that you shouldn’t address the issue? Absolutely not!
The legal timelines provided to address repairs should be considered a minimum expectation. Tenants consider whether their property maintenance requests are being addressed when they choose to stay, or leave, a property when it comes time to renew.
Maintenance requests should be responded to within one business day. That doesn’t mean that they have to be resolved in one business day, but the tenant should at least know that you have received the message and are actively working on to get someone to address the issue within one business day.
